Australia terminates the resumed anti-dumping investigation on China's formulated glyphosate

On 24 June, 2013, Australia Customs and Border Protection Service (ACBPS) released Notice No. 2013/51 (The Notice), showing the result of anti-dumping investigation on formulated glyphosate products exported to Australia from China resumed on 16 Nov., 2012, namely these three China's glyphosate companies haven't dumped in Australia and ACBPS terminated this resumed anti-dumping investigation, according to CCM’s latest newsletter, Glyphoste China Monthly Report issued in July.

According to The Notice, these three China's glyphosate companies, namely Jiangsu Good Harvest-Weien Agrochemical Co., Ltd. (Jiangsu Good Harvest-Weien), Shandong Weifang Rainbow Chemical Co., Ltd. (Shandong Weifang Rainbow) and Zhejiang Wynca Chemical Industry Group Co., Ltd. (Zhejiang Wynca), are judged that they haven't dumped formulated glyphosate products in Australia, so ACBPS decided to terminate the resumed investigation in accordance with s.269TDA(1) of the Customs Act 1901.

Besides, the total export volume of glyphosate formulations to Australia that have dumped from all other Chinese exporters was negligible, so ACBPS decided to terminate the resumed investigation in accordance with s.269TDA(3) of the Customs Act 1901.

Anyway, it's the second time that ACBPS terminated the anti-dumping investigation on formulated glyphosate products exported to Australia from China since this anti-dumping investigation initiated on 6 Feb., 2012 lodged by Nufarm Limited (Nufarm) and Accensi Pty Limited (Accensi), the top two manufacturers of formulated glyphosate in Australia, and the first time was on 2 Aug., 2012.

It seems that the termination hasn't exhilarated some Chinese glyphosate producers and the glyphosate products prices in China did not fluctuate much. Take Zhejiang Wynca for example, Zhejiang Wynca claimed that this termination will have some positive impact on developing the glyphosate market in Australia, but the impact is estimated to be low. As to the glyphosate price, it's still stable in China, and the ex-works price of glyphosate technical in China keeps at about USD5,800/t-USD5,900/t at present.

But for the glyphosate producers who are eager to enlarge the glyphosate market in Australia, the result of investigation was worth cheering. Take three glyphosate companies for examples. Jiangsu Good Harvest-Weien, Shandong Weifang Rainbow and Sichuan Fuhua Tongda Agro-chemical Technology Co., Ltd. (Sichuan Fuhua) all have glyphosate registrations in Australia at present. They are always regarding Australia as one of their most important glyphosate market.

However, the proportion of these three companies' glyphosate A.I. export volume to Australia in 2012 in their total glyphosate A.I. exports has decreased to about 19.14%, down by about 8.75 and 7.67 percentage points over 2010 and 2011 respectively. The Australia's investigation result is expected to help increase the export volume of glyphosate manufactured by these three companies in the whole year of 2013.

Anti-dumping is a normal taxation measure to prevent domestic industry from damage caused by under-pricing imported products. China's glyphosate products have encountered anti-dumping issues in many regions including Brazil, Argentina, Australia, the US and the EU. Dumping accusation of China's glyphosate products in overseas markets has indicated the products' poor competitiveness and simplistic sale strategy (low-price strategy only) in the international market.

Zhejiang Wynca Finally Wins the Long-run Glyphosate Anti-dumping Case

Zhejiang Wynca Chemical Industry Group Co., Ltd. (Zhejiang Wynca), a leading glyphosate producer in China, announced on 24 July, 2012 that it has finally won the glyphosate anti-dumping case accused by the Council of the European Union (the CEU) since 2000. Thus Zhejiang Wynca becomes the first domestic company to challenge the unfair trade remedy investigation initiated by the CEU and gained two trials' victory, according to CCM International’s latest issue of Crop Protection China News.

The winning of the glyphosate anti-dumping case has greatly cheered up domestic glyphosate production enterprises, especially Zhejiang Wynca. The company now believes that it is worth laying 12 years' effort to cope with the anti-dumping case because the winning has made a good demonstration effect to all of domestic glyphosate producers who may face anti-dumping investigation in the future and it has also helped domestic glyphosate producers set up confidence in exploring market in the EU.

Even so, Zhejiang Wynca has still paid great price on the anti-dumping case because of the long-run lawsuit which has made it almost lose the glyphosate market shares in the EU in the past few years. According to the financial report of Zhejiang Wynca in 2011, although its revenue in overseas market in this period reached USD286.38 million, accounting for nearly 40% of its total revenue, its revenue of glyphosate exported to the EU accounted for a very tiny part of the revenue in overseas market. Now, as the company has won the anti-dumping case, it believed that its market expansion of glyphosate in the EU will be much smoother.

However, the market exploring in the EU may not be as easy as what Zhejiang Wynca believes. It is heard that the CEU is not resigned to give up but still preparing launching trade remedy investigations by itself.

In the past decade, domestic glyphosate has been facing anti-dumping investigations in overseas markets. Owing to the lower cost of the production of domestic glyphosate, the more competitive price of domestic glyphosate compared to those products in some other countries has threatened the local producers. In addition to the EU, Brazil and Australia have ever levied anti-dumping duties on Chinese glyphosate. In a bid to protect domestic glyphosate industry, most countries would set up trade barrier with the name of anti-dumping to charge extra duties on the glyphosate originated from China. It is becoming a usual measure for these countries used to protect local glyphosate industry. Eyeing the intensive competition in overseas markets, this kind of protection measure will be used much more frequently in the future.

Events review

In Feb. 2000, the European Union (the EU) started to levy 48% anti-dumping duty over glyphosate originating from China.

In Feb. 2003, the EU initiated merger investigation towards Chinese glyphosate. Zhejiang Wynca, as the representative of domestic glyphosate industry, responded to the prosecution exclusively.

In Sept. 2004, the EU decided to levy 29.9% of anti-dumping duty over Chinese glyphosate.

In Dec. 2004, Zhejiang Wynca claimed that it appealed against the decision of the EU and decided to prosecute to the decision to the European Court of First Instance.

In May 2009, the EU claimed to suspend levying anti-dumping duty over Chinese glyphosate for a period of nine months.

On 17 June, 2009, the European Court of First Instance made a judgment to cancel levying final anti-dumping duties over the glyphosate from Zhejiang Wynca.

In Aug. 2009, the CEU sued the verdict of the European Court of First Instance to the European High Court of Justice.

On 19 July, 2012, European High Court of Justice made the final judgment that Zhejiang Wynca finally won the lawsuit.

Identity of Long-term Contract Workers Bothering Domestic Pesticide Players

China's pesticide industry has witnessed great development in the past few decades and lots of excellent pesticide enterprises emerged in domestic pesticide market, such as Zhejiang Wynca Chemical Industry Group Co., Ltd., Jiangsu Yangnong Chemical Co., Ltd., Hubei Sanonda Co., Ltd. and Nanjing Redsun Co., Ltd. These pesticide enterprises have shown great competitiveness and influence, and become the mainstay in the development process of domestic pesticide industry, based on CCM’s latest issue of Crop Protection China News.

However, as more and more problems appear in domestic pesticide industry, such as overcapacity, over competition, lack of innovation capability and chaotic market management, the survival condition of domestic pesticide enterprises has changed from bad to worse.

As CCM International reported in the last issue, the high-profile list, namely 2011 China Top 100 Pesticide Manufacturers, showed the ranking of 100 domestic pesticide manufacturers and their revenues in 2010. It is till now the most authoritative version of pesticide enterprise rankings in China.

Although it should be excited for companies who are on the list, most of them feel very depressed.

It is very disappointed to see the result of comparing the total revenue of most competitive domestic pesticide manufacturers to one foreign pesticide giant, namely Syngenta. According to the list of 2011 China Top 100 Pesticide Manufacturers, the total revenue of the first 100 pesticide manufacturers reached USD7,803.62 million. However, the pesticide revenue of Syngenta in 2010 reached USD8,900 million with a growth rate of 3% over 2009.

"We are just long-term contract workers of foreign pesticide giants even though we think we are good enough," said Professor Zhang Yibing from Shanghai Pesticide Research Institute. And this point of view has been agreed by most pesticide players in China.

"We provide technical products with high quality to foreign pesticide giants but only gain little OEM (original equipment manufacturer) profit," said an insider from a listed pesticide manufacturer.

Actually, most of the pesticide manufacturers whose names appear on the top of the list have kept good relationships with foreign pesticide giants in recent years. For example, Zhejiang Wynca Chemical Industry Group Co., Ltd., Hubei Sanonda Co., Ltd., Jiangsu Changqing Agricultural Chemical Co., Ltd., etc. are the main pesticide suppliers of Bayer in China; Jiangsu Yangnong Chemical Co., Ltd., Nantong Jiangshan Agrochemical & Chemicals Co., Ltd., Jiangsu Huifeng Agrochemical Co., Ltd., etc. are the main pesticide suppliers of BASF in China.

Although China is considered to be one of the largest pesticide production and consumption countries in the world, its pesticide industry is highly depended on export with an export dependence ratio of over 50%. Its pesticide export volume reached over 1 million tonnes in the past three years. In 2010, domestic pesticide output reached 2.34 million tonnes and the export volume reached 1.22 million tonnes.

Eyeing that the price of raw materials, cost of environmental protection and labor, RMB appreciation, etc. rapidly rose in H1 2011, domestic pesticide manufacturers suffered great pains in running pesticide business this year.

The identity of long-term contract workers being labeled on domestic pesticide manufacturers bothers them seriously now and then. Although they have been considering changing the situation through technology innovation, with Chinese government's high-profile encourage but poor continuous investment in pesticide R&D, the development of pesticide innovation is painfully slow. Thus, aiming to survive in domestic pesticide market and account for more market shares, most domestic pesticide enterprises are more inclined to the production of off-patent pesticides and OEM production for foreign pesticide enterprises. Shaking off the identity of long-term contract workers means a lot to domestic pesticide players. However, without the support from strong policies and more investment in pesticide R&D from Chinese government, there may still be a long way to go.

2011 Top 100 China Pesticide Manufacturers Come Out

“2011 Top 100 List of China Pesticide Manufacturers” has been released by China Crop Protection Industry Association at 11th National Agrochemical Exchange Meeting on Oct. 19th, 2011.

The top 100 pesticide manufacturers in China are ranked according to the companies' revenue in 2010 from domestic market. Zhejiang Wynca Chemical Industry Group Co., Ltd. (Zhejiang Wynca), a large listed pesticide company in China mainly engaged in glyphosate and anosilicon business, ranks No.1 with total revenue of USD294.96 million in 2010.

The second place and the third place belong to Jiangsu Yangnong Chemical Co., Ltd. and Zhejiang Jinfanda Biochemical Co., Ltd. with total revenue of USD235.59 million and USD229.13 million in 2010 respectively.

The companies shown in the top 100 list may have great strength, but they still lack competitiveness when facing international pesticide giants. In order to boost the development of domestic pesticide industry, China’s pesticide manufacturers should solve problems of chaotic pesticide market, inefficient pesticide production technology, uncompetitive strength etc.

The above is extracted from CCM’s latest issue of Crop Protection China News. If you are interested in it, please feel free to contact us at econtact@cnchemicals.com.

List of 2011 China Top 100 Pesticide Manufacturers Released

On 19 Oct. 2011, the high-profile list, namely 2011 China Top 100 Pesticide Manufacturers, has been released by China Crop Protection Industry Association at the 11th National Agrochemical Exchange Meeting during 19 Oct. to 21 Oct. 2011, based on CCM’s latest issue of Crop Protection China News.

The top 100 pesticide manufacturers in China are ranked according to the companies' revenue in 2010 from domestic market. Zhejiang Wynca Chemical Industry Group Co., Ltd. (Zhejiang Wynca), a large listed pesticide company in China mainly engaged in glyphosate and anosilicon business, ranks first with its total revenue of USD294.96 million in 2010. The second place and the third place respectively go to Jiangsu Yangnong Chemical Co., Ltd. and Zhejiang Jinfanda Biochemical Co., Ltd. with their revenues of USD235.59 million and USD229.13 million in 2010 respectively.

Among all the listed pesticide manufacturers, there are 82 pesticide technical manufacturers, among which Zhejiang Wynca ranks No. 1. The rest 18 companies are pesticide formulation players, among which Shenzhen Noposion Agrochemical Co., Ltd. (Noposion, the largest pesticide formulation player in China), ranks first with its revenue of USD225.83 million in 2010.

Some listed pesticide companies didn't perform well in 2010. Shandong Huayang Technology Co., Ltd. (now is changed into a mining company after being merged) ranks 80th with its revenue of USD36.22 million in 2010. There are 21 listed pesticide companies appeared on the list of Top 100 Pesticide Manufacturers. However, only ten of them rank as the first twenty manufacturers.

It is calculated that there are ten pesticide manufacturers whose revenue in 2010 surpassed USD157.48 million (RMB1 billion). The total revenue of the top ten pesticide manufacturers adds up to USD2.05 billion, accounting for 26.3% of the total revenue of the top 100 pesticide manufacturers, about USD7.8 billion.

There are 24 pesticide manufacturers who gained revenue between USD78.74 million (RMB500 million) and USD157.48 million (RMB1 billion) with total revenue of USD2.64 billion in 2010, accounting for 33.80% of the total revenue of the top 100 pesticide manufacturers.

The revenue of 66 pesticide manufacturers among the 100 pesticide manufacturers is less than USD78.74 million (RMB500 million) in 2010. Their total revenue adds up to USD3.11 billion, accounting for 39.87% of the total revenue of the top 100 pesticide manufacturers.

As one of the largest pesticide markets and pesticide production countries in the world, China is believed to own great potential in pesticide industry. However, the reasons like chaotic pesticide market, inefficient pesticide production technology, pesticide companies lacking strong competitiveness, etc. all drag down the development of domestic pesticide industry. The companies which are shown as the top 100 pesticide manufacturers in China may own good strength in pesticide business. However, they still lack good competitiveness while facing international pesticide giants. It can be easily seen from the total revenue of the top domestic 100 pesticide manufacturers which did not exceed USD7.87 billion (RMB50 billion) in 2010.
